Welcome, and thank you for choosing Images By JRod LLC (“Images By JRod,” “we,” “us,” or “our”). By booking a session, signing a contract, paying a deposit, or using our services, you (“Client” or “you”) agree to the Terms of Service outlined below. Please read them carefully.

1. Services Provided

Images By JRod LLC offers the following professional photography and media services:

• Weddings
• Quinceañeras
• Family Portraits
• Senior Portraits
• Business and Professional Headshots
• Real Estate Photography

We also offer video services, professional photo editing, printed products, and digital delivery. Specific deliverables for your event or session will be listed in your service contract.

2. Booking and Payment

2.1 Deposit

A deposit is required to reserve your event date or session time. The date is not held on the calendar until the deposit has been received. Flexible payment options are available and can be discussed before the contract is signed.

2.2 Non-Refundable Deposit

Once the contract is signed, the deposit becomes non-refundable. The deposit covers the time we reserve for you and the work we turn away in order to hold your date.

2.3 Final Balance

The final balance is due on the following schedule:

• Events (weddings, quinceañeras, and similar): 1 week prior to the event date.
• Portrait sessions (family, senior, headshots, real estate): 1 day prior to the scheduled shoot.

Services will not be delivered until all balances are paid in full.

2.4 Accepted Payment Methods

We accept Zelle and credit or debit cards. Any fees charged by a payment processor are the responsibility of the Client.

3. Cancellations and Rescheduling

3.1 Client Rescheduling

If you need to reschedule, please give us at least 48 hours of notice prior to the event or session. We will do our best to move your booking to another available date. Rescheduling is subject to photographer availability.

3.2 Client Cancellation

Cancellation terms depend on the type of service:

• Events (weddings, quinceañeras, and similar): All deposits and payments made are non-refundable.
• Portrait sessions: We retain 50% of the total cost of the service as a cancellation fee. Any amount paid above 50% will be refunded.

3.3 Photographer Cancellation

If Images By JRod LLC must cancel due to illness, emergency, or other circumstances outside our control, you will receive a 100% refund of all amounts paid. Where possible, we will also help arrange a replacement photographer of similar skill, but this is not guaranteed.

4. Delivery of Photos and Videos

4.1 Turnaround Time

Estimated delivery times are:

• Events: 3 to 5 weeks after the event date.
• Portrait sessions: 7 to 14 days after the session date.

Turnaround may vary during peak seasons. We will keep you updated if any delay occurs.

4.2 Delivery Method

Final photos and videos are delivered through a private online gallery or private webpage. Access information will be sent to the email address you provide.

4.3 File Retention

RAW files are stored for 90 days after the event or session, after which they may be permanently deleted. Final edited files remain available for up to 1 year from the date of service. We strongly encourage you to download and back up your files as soon as possible.

5. Image Rights, Copyright, and Usage

5.1 Copyright

Images By JRod LLC retains the copyright to all photos and videos created. The Client receives exclusive personal-use rights to the final delivered images.

5.2 Personal Use by the Client

You may print, share, and post your images for personal, non-commercial use. Commercial use, resale, or licensing of the images by the Client requires written permission from Images By JRod LLC.

5.3 Portfolio and Marketing Use

We reserve the right to use selected images and videos from your session for our portfolio, website, social media, advertising, and promotional materials. If you prefer that your photos not be used for these purposes, you may purchase our Exclusive Privacy Option for an additional fee. This option must be requested in writing before delivery.

5.4 Edits and Artistic Control

All editing choices, including color, tone, cropping, and final selections, are made by Images By JRod LLC using professional judgment. Requests for additional edits beyond what is included in your package may be available for an added fee.

6. Weather Policy for Outdoor Shoots

If weather conditions do not allow an outdoor shoot to take place safely or as planned, we will reschedule the session one time at no additional charge, subject to photographer availability. A second rescheduling due to weather may require an added fee to cover extra time and travel.

7. Limitation of Liability

To the fullest extent allowed by law, the total liability of Images By JRod LLC for any claim connected to our services is limited to the total amount paid by the Client for the specific service in question. We are not responsible for indirect, incidental, special, or consequential damages, including lost profits, lost memories, or emotional distress.

In the rare event of equipment failure, file corruption, loss, theft, or other circumstances beyond our reasonable control that prevent delivery of some or all images, our liability is limited to a refund of the amount paid for the affected portion of the service.

8. Client Responsibilities and Conduct

To help every session run smoothly and safely, the Client agrees to the following industry best practices:

• Provide accurate event details, timelines, and contact information before the event or session.
• Make sure all guests, participants, and minors are supervised and behave respectfully toward the photographer, the crew, and all equipment.
• Keep children under the direct supervision of a parent or guardian at all times during the session.
• Keep the shoot area safe and free of hazards, and give the photographer reasonable space to work.
• Obtain any needed permits or property permissions for the chosen location. Any fees charged by a venue or property are the responsibility of the Client.
• Refrain from interfering with the photographer’s creative and technical decisions during the shoot.
• Treat the photographer and crew with respect. Harassment, threats, intoxication to the point of disruption, or unsafe behavior may result in the session ending early with no refund.

If the safety of the photographer, crew, or equipment is at risk, Images By JRod LLC reserves the right to pause or end the session. In that case, any balance owed remains due and no refund of amounts paid will be issued.

9. Model Release

By booking a session and agreeing to these Terms, the Client grants Images By JRod LLC permission to use images from the session for the portfolio and marketing purposes described in Section 5.3, unless the Exclusive Privacy Option has been purchased.

10. Force Majeure

Neither party is liable for failure to perform due to events outside reasonable control, including natural disasters, severe weather, fire, illness, pandemics, government orders, acts of terrorism, or loss of venue. In those cases, both parties will work together in good faith to reschedule or find a fair solution.

11. Dispute Resolution

If a dispute arises between the Client and Images By JRod LLC, both parties agree to first try to resolve the matter through good-faith discussions.

If the dispute cannot be resolved informally, the parties agree to submit the matter to mediation in Dallas County, Texas, with a mutually chosen mediator. Mediation costs will be split equally by both parties.

If mediation does not resolve the dispute, the matter will be settled through binding arbitration in Dallas County, Texas, under the rules of the American Arbitration Association. The decision of the arbitrator will be final and enforceable in any court of competent jurisdiction. Each party is responsible for their own attorney fees unless the arbitrator decides otherwise.

12. Governing Law

These Terms of Service are governed by and interpreted under the laws of the State of Texas, without regard to conflict-of-law rules. The venue for any legal action not covered by arbitration will be the state or federal courts located in Dallas County, Texas.

13. Changes to These Terms

Images By JRod LLC may update these Terms of Service from time to time. The most current version will always be posted on our website at imagesbyjrodtx.com. Continued use of our services after updates means you accept the revised Terms.
